The inveterate problem that each town faces when waged in a battle against our state's corporate interests is the steadfast nature of NJ LAW. As it exists now, the town cannot just declare that the tract, or any tract, is to be open space, or anything else it wants. The power of any town's board, be it zoning or planning, is extremely limited in scope. The illusion of complete representative democracy seems to be the vanguard and ultimate impetus of the civil war between the town's people and its elected officials. From north to south this battle is being waged in this state; it is a battle that cannot be won. Boards say no and the courts reject them, and rightfully so, because the decisions violate the state law. Change the law, and you create a seachange in the state. No one should hold his or her breath on this point for fear of quick suffocation; this town would rather attack each other than the root of the current affair before us: the pernicious hand of state law.
