A local resident has been contacted who works for the federal government. Here is the response toward your concerns about illegal immigration:
"Well, there are a few issues here. There really is nothing that Jamesburg can do to prohibit illegal immigration. Pretty much anything that the town does will be challenged as a civil rights issue. At this time, the federal government is the only entity that can regulate or enforce immigration laws. There is some legislation being discussed that would transfer some powers to local law enforcement, but at this point, the only thing Jamesburg can do is refer any potential illegal immigrants to Immigration and Customs Enforcement (ICE).
We all need to realize that a lot of the immigrants that they feel are illegal, may in fact be legal. Unfortunately immigration status cannot be determined by looks or language.
There was a Supreme Court case back in the late 80’s/early 90’s that declared it a civil rights violation to stop children from going to public school, regardless of their immigration status. They are still deportable and if caught, can be removed, but while they are here, they have the right to education. I am not sure about the school districts ability to require immigration status be declared by the parents when the child is registered, or what they could do with that information.
Here is what we can do as a community:
1) call the local ICE Office in Newark and report any and all illegals that they are aware of, and
2) contact their respective Congressmen to discuss their feelings on immigration issues and how it affects small towns.
This is a huge issue nationwide. It is regulated by the federal government and there is a lot of political pressure both ways. The only proactive thing that Jamesburg can do, would be to enforce the existing ordinances we have (mainly housing) and make it a policy to refer all instances where illegals are found to ICE.
ICE has been in Jamesburg twice within the past 6 months. They have arrested approximately 15 people and there are a few more on the list. Our police department has cooperated with them in the effort."
